What is Asbestosis?
Asbestosis (also in some cases called fibrosis) is a lung disease caused by inhaling asbestos fibres and dust over a considerable and prolonged length of time. The lungs become scarred and eventually asbestos bodies embed themselves in the lung tissue causing respiratory problems and increasing the risk of lung cancer. (Further information regarding Asbestosis including: exposure, diagnosis, symptoms, treatment can be found here.)
Can I claim compensation for Asbestosis?
If you or a family member have been diagnosed with an asbestos related illness or cancer as a result of another person’s negligence such as a previous employer, you should be able to make a claim for compensation.
Our client worked for Turner Asbestos Limited as a representative for them covering a wide area including Northern Nigeria. He moved to Nigeria and worked for the company from 1970 to 1977. During his employment he was exposed to asbestos dust in the manufacturing factory in Nigeria and has since been diagnosed with lung cancer and asbestosis. Turner Asbestos Limited has since gone into liquidation and our solicitors have managed to successfully pursue a claim against Turner Newall Asbestos Trustee Company (a Trust set up to deal with these claims). Our client received £51,000 in damages.
This case highlights our Asbestos disease and illness team’s ability to pursue claims against companies that have since gone into liquidation and those that have an international element.
Is there a time limit for Asbestosis compensation claims?
You have period of 3 years in which to issue proceedings through a solicitor from when you first became aware that your condition was asbestos exposure related failing which your claim may be statute barred.
Alternatively, close relatives considering bringing a claim for compensation on behalf of a victim who has recently passed away as a result of an asbestosis, have a time limit of 3 years from the date of death.
What type of information do you need for my claim to succeed?
It will help our solicitors deal with your asbestosis compensation claim if you can identify:
- the company or companies where you believe exposure to asbestos took place
- if an employer/company no longer exists we will need to try and find out who the insurers of the company where at the time of the allege exposure to asbestos – our solicitors can carry out the research to try and locate the relevant insurers for you
- we also then need to establish that your employer(s) failed to provide proper protection from harmful asbestos fibres
